王金平保黨權　國民黨抗告：法院無權審判

【法庭中心／台北報導】國民黨委任律師陳明下午17：39正式代表國民黨向台北地院提出王金平黨權假處分的抗告，陳明指出，這次抗告主要理由有2點，第1、律師團檢附高院裁定及日本判決，指出政黨對黨員的處分是政黨自治事項，普通法院沒有審判權。

第2、王金平的立委資格，最遲在註銷黨籍公文送到立院，立院收到時，王金平的立委資格就已經消滅，律師團認為既然當下已喪失，就沒有假處分的必要。
律師團表示，還會陸續提出其他理由向高院報告。
