新北巿陳姓房東認為房客在租屋處燒炭自殺身亡，房子變成凶宅而難租售，向房客的父母求償300萬元。法院今天判房東敗訴。

判決指出，陳姓屋主在民國101年2月1日起將逾25坪的房子租給許姓房客，但許男在同年6月17日在房內燒炭自殺身亡，導致房子成為凶宅，至今閒置，無法出租或賣出。

陳姓房東主張，房子巿價為新台幣1000萬元，若要賣出，只能以巿價6折售出，之間有400萬元的損失，因此向許男在民法上的繼承人（許男父母）求償300萬元。

法院審理後認定，本案應為「純粹經濟上損失」，是一種並非因被害人的有形財產或具體人身受損害而引起的經利益損失，且不符合民法184條第1項前段的保護範圍，而且房屋所有權仍在房東，房子也沒有被毀損或功能損壞，因此判房東敗訴，全案可上訴。(中央社)
