【公庫】菸捐不是社福萬靈丹 菸權會向立院請願「凍漲」

菸捐恐再漲25元？今（9/17）台灣吸菸者權益促進會前往立院請願，針對立法院本會期優先項目「菸害防制法」第4條修正案提出呼籲，訴求立院審議應「凍漲」菸品健康福利捐。菸權會表示，人民有納稅的義務，但沒有「納捐」之義務，是為違憲之徵收，要求立院訂出停徵菸捐的落日條款。

台灣吸菸者權益促進會理事長陳麒安說明，菸品健康福利捐其依據為「菸害防制法」第4條，而非從屬菸酒稅的附加稅，「菸酒稅法」第22條明定　菸捐課徵為菸品，應由稅捐機關收菸酒稅時代徵，課徵主體為菸品製造商或進口商。當菸商將菸捐轉嫁給消費者，而消費者被迫接受一個憲法沒有義務要繳的費用捐。...(閱讀全文)
