元旦強迫上班 僱主罰30萬元

【李定宇╱新北報導】下周三就跨入二○一四年，新北市勞工局昨提醒勞工，元旦是《勞基法》認定的休假日，若公司要求員工加班，需給予加班費或提供補休，若公司未遵守《勞基法》，勞工可向勞工局申訴，「僱主最高將處以三十萬元罰金！」

隔周休2日應放假

新北市勞工局昨指出，下周三元旦為「中華民國開國紀念日」，周四也是《勞基法》所訂應放假休假日，勞工服務單位如為隔周休二日或雙周工時八十四小時皆應依法放假。如為周休二日或雙周工時八十小時，並配合辦公日曆施行休假，因周四調移至其他工作日，故無休假問題。
勞工局長謝政達提醒，若公司要求勞工於元旦上班，除徵得勞工同意，當天工資亦應加倍發給或擇日補休，否則最高可裁罰三十萬元。

基本工資時薪調高

另明年基本工資時薪從一百零九元調整為一百一十五元，月薪自明年七月起從一萬九千零四十七元調整為一萬九千兩百七十三元，僱主需依法調整。勞工若遇單位不顧勞工權益，可撥1999向勞工局提出申訴。
