印度反同性戀法　最高法院決定續沿用

【林沿瑜／綜合報導】印度最高法院今天宣布，印度150年前殖民時期所訂定的反同性戀法律依然有效。印度同志平權人士近年來積極奔走呼籲，印度高等法院2009年也認定反同性戀法律違憲，但最高法院今天仍說，同性戀是否合法應由國會議員決定，而非法院的認定。
 
最高法院判決確定後，法院外的數十名同志平權人士相擁而泣。一名同志平權人士說：「這對我們而言是非常傷痛的一天，在同志社群爭取權利的道路上，我們又回到了原點。」同志平權律師葛羅沃（Anand Grover）強調：「我們的抗爭行動不會停止。」
 
印度高等法院2009年做出有利同性戀的判決時，即激怒了指稱同性戀不符合自然法則的保守宗教團體。根據印度1860年代殖民時期的法律，進行「違反自然法則」的性行為，將被處以最高10年的有期徒刑。
