塑毒風暴判賠低　消基會律師：官方扯後腿

【黃哲民／新北報導】針對塑化劑風暴消費者集體求償判決不如預期，判決金額120萬餘元，僅約求償24億餘元的200分之1，消基會律師徐則鈺今痛批，衛生福利部轄下單位在網站公佈人吃了塑化劑，24小時後就會排出體外，成為被告公司最有力的辯解。徐直說：「這樣非常不恰當！不應該！氣死了！」

徐則鈺說，訴訟期間被告業者提出衛福部食品管理署、國民健康署網站資料，辯解主管機關認為塑化劑吃進人體，會在短期內代謝排出體外，趕緊詢問衛福部為何公布這種資訊。

徐則鈺說，主管機關回覆引用國外動物實驗結果，卻不知如此會造成求償訴訟極大困擾，因法官比較會採信主管機關意見，何況直接把國外動物實驗結果大剌剌擺在官方網站上，「這樣恰當嗎？」

徐則鈺痛批，行政院一方面委託消基會為消費者提告，行政院底下的單位卻扯後腿，他覺得「氣死了」，但消基會一定會幫消費者上訴，並尋求學者專家提供積極證據證明塑化劑對人體會造成何種危害。
