道路交通安全規則 第 88 條 機車附載人員或物品，應依下列規定：

一、載物者，小型輕型不得超過二十公斤，普通輕型不得超過五十公斤，
重型不得超過八十公斤，高度不得超過駕駛人肩部，寬度不得超過把
手外緣十公分，長度自座位後部起不得向前超伸，伸出車尾部分，自
後輪軸起不得超過半公尺。

二、小型輕型機車不得附載人員，重型及普通輕型機車在駕駛人後設有固
定座位者，得附載一人。

三、附載坐人後，不得另載物品。但零星物品不影響駕駛人及附載人員之
安全者，不在此限。

四、附載坐人不得側坐。

五、駕駛人及附載坐人均應戴安全帽。

六、裝載容易滲漏、飛散、氣味惡臭之貨物，能防止其發洩者，應嚴密封
固，裝置適當。

七、附載坐人、載運貨物必須穩妥，物品應捆紮牢固，堆放平穩。
