案例二…沒補休沒加班費

「主動爭取福利，卻在颱風天前遭解雇，一個人帶著所有家當，冒著風雨下山。」清大社會系畢業，目前就讀清大人文社會研究所的徐珮瑄，研究所還沒畢業，就放著論文，跑到合歡山松雪樓去當派遣房務人員；她本來想寫游泳選手相關論文，現決定改做派遣勞工的血淚史。

徐珮瑄表示，她在松雪樓當派遣工，每月薪水有三萬元，扣掉勞健保剩兩萬八，薪水還過得去；但福利跟公務人員差很大，每個月只休五天，加班沒有補休或加班費，最糟糕的是，雇主若不爽，可以隨時「叫你走路！」

對於徐珮瑄指控，林務局回應，她在七、八月間出現工作延遲，沒請假又沒上班，東勢林管處只是依合約請派遣廠商注意指導，結果廠商解雇徐。至於林務局不顧天候不佳將她趕下山，林務局說，因徐工作地點在高山，基於安全，才請徐在颱風警報發布前離開。
