涉嫌凌虐下士洪仲丘致死的戒護士陳毅勳，1日下午在羈押庭上，一概以「我行使緘默權」來回應法官的訊問。
記者呂炯昌／台北報導 陸軍269旅戒護士陳毅勳於1日經北部地方軍法院裁定交保，北部地方軍法院發布新聞稿說明交保理由: 被告訊問時雖行使緘默權，惟此乃軍事審判法賦予被告之權利，縱被告102年7月3日上午涉有要求禁閉（悔過）生操作多項高強度之體能訓練項目，僅給予短暫休息，在洪仲丘反映體力無法負荷時，仍執意要求洪仲丘繼續操作，及未能即時提供洪仲丘飲水等事實，然軍事檢察官偵查中已傳訊相關人員到庭作證，無湮滅、偽造、變造證據或勾串共犯或證人之虞。 其次，被告羈押後，依陸海空軍軍官士官任職條例依法停職，惟依陸海空軍軍官士官服役條例規定，仍具現役軍人身分，依法應辦理復職，本院並函請被告所屬單位注意被告心輔及正常作息，且應隨傳隨到，故尚難認有逃亡之虞。 再者，本案雖屬最輕本刑5年以上有刑徒刑之罪，按大法官釋字第665號解釋「被告涉犯最輕本刑5年以上有期徒刑之罪，且嫌疑重大者，仍應有相當理由認為其有逃亡、湮滅、偽造、變造證據或勾串共犯或證人等之虞，方符合羈押必要性」之意旨，認無羈押必要，命以新臺幣15萬元具保候傳，並命被告休假時，應每日10時前至宜蘭縣政府警察局蘇澳分局報到，如無故未按時報到，合議庭將重新審酌被告是否有逃亡之虞。
