懷生重劃案判決惹議　最高法院開庭辯論

【劉昌松／台北報導】台北市懷生重劃區地主之一台灣省農會，不滿重劃會賤賣土地籌款，憤而提告求償，但高院以重劃會不具有法人地位，無法賠償負責等理由判農會敗訴。農會不服提上訴，最高法院今開庭辯論。

懷生重劃案是台北市都更案中少數成功並已開始興建的自辦土地重劃案，但農會不滿重劃會在2007年間，為了籌措經費，以低於市價1/3的價格賤賣部分土地，其中，農會不甘損失7000多萬元，怒提告求償。

高院認定，重劃會是所有地主是基於合夥關係所組成，就算重劃會要賠錢，也應賠給全體地主，農會不能單獨求償。

高院判決不但引起農會不服，連重劃會也質疑若是合夥關係，等於所有重劃會成員（所有地主）未來都可向重劃會提告，將影響都市發展的安定性，因此也派人出庭，請求最高法院明確定義重劃會的法律地位。全案定1月16日宣判。
