法官認判竊盜罪太重　男偷1.6元電免刑

【蔡進男／基隆報導】基隆市廖姓男子，因沒錢繳電費，被斷電，廖男見住家旁里民會堂陽台窗戶未關，竟攀越窗戶爬進去，從廁所偷接電，供60瓦燈炮使用，4天後被發現，因廖男有毒品前科，屬於累犯，且未與被害人和解，檢方依「踰越安全設備竊盜罪」起訴。

法官認為，該罪責本刑為6月以上、5年以下有期徒刑，廖男偷電使用共10小時，電費僅1.632元，還不到2元，即使減刑仍嫌過重，且已取得被害人原諒，判決有罪但免刑，仍可上訴。
