首例！重機上國道抗議　法官引兩公約判免罰

【丁牧群／台北報導】簡姓重機騎士2012年參加警方核准的「訴求550cc.以上大型重型機車行駛高速公路」集遊活動，數百輛重機聚集交通部前抗議，因談判破裂，其中50多人臨時決定騎重機上高速公路抗議，行經國道三號東向4.9公里處，被國道警察木柵分隊攔下，對50多人開了80多張罰單。
 
簡男被開一張「同車道違規併駛」的4千元罰單，但他認為當時警察把一群重機攔下，大家才被迫騎在同一車道，因此打行政訴訟抗罰。桃園地院法官錢建榮日前判簡男免罰，判決中重批警方「為處罰而處罰」，視臨時性集會為「毒蛇猛獸」，一心只想壓制，而非從旁協助維持交通，違背「兩公約」保障和平集會的精神。這是台灣首件以兩公約宣告行政機關行政行為違法無效的案子。
