通訊行 現場手機T2拆封有瑕疵 要消費者接受送修檢測後換新品 而不能退貨

小弟查了民法及消保法相關規定
消費者在門市購買時 當場發現手機有瑕疵sony t2 並未帶離開門市 有權退貨 或換新品
但這間門市卻說公司規定 只能送修 或換新品 說不能退貨
這樣子是有違規定的 我無法接受這種公司的做法
我手機連用都還沒用過 當場由店家開封測試 手機就是不能讀取記憶卡 當場他們測了好幾張都不行
卻要我接受只能等他們去維修換新機 連用過都沒用過誰能接受?

但我必須強調一點 服務人員態度很好
但這是針對公司這種根本不保障消費者權益 無法接受

今天我決定一定要退貨退費! 手機都還在門市! 我根本沒用過!
就看事情今天店家怎麼處理!
