排水溝撿到保險套　不能當妨害風化證據

基隆市警方今年4月間，在市區1家美容舒壓館包廂內，查獲周姓男客與劉姓女服務生，共處一室，並在店家後面的排水溝內，找到用過的保險套，店內所有女服務生都否認有性交易服務，也不知水溝內的套子是誰的，但是因為1名丁姓店員警訊時，坦承店內有作半套服務，警方因此依妨害風化罪嫌，將31歲謝姓負責人及清潔、把風的22歲丁姓、36歲林女職員送辦。

但是檢方偵訊時，丁男翻供辯稱，警方上門當時感到很害怕，腦筋一片空白，他到職只有10多天，只知店內經營身體保養工作，當天警訊時，根本不知道自己是在說什麼！檢方認為丁男供詞反覆有瑕疵，而現場未扣到其他使用過的保險套，店外水溝內的保險套也不知何人所有，並無積極證據證明3名被告妨害風化犯行，因此裁定3人不起訴處分。（蔡進男／基隆報導）
