阻當選立委遷籍　內政部：涉憲法遷徙自由需審慎

針對民進黨立委邱議瑩上午在立法院內政委員會詢問，區域立委當選後是否限制戶籍遷出各該選舉區，內政部今晚發布新聞稿表示，涉及《憲法》保障人民居住籍遷徙自由，且現行相關法令並無限制立委遷出原選舉區而喪失資格規定，過去也有立委將戶籍遷出的前例，是否修法，將廣泛徵詢、審慎研究。

內政部說，按《地方制度法》第79條規定，地方公職人員若將戶籍遷出各該行政區域4個月以上，應解除其職權或職務。其中縣（市）議員、鄉（鎮、市）民代表戶籍之遷出，是指遷出縣（市）、鄉（鎮、市）行政區域，如果是戶籍遷至同一縣（市）、鄉（鎮、市）行政區域之其他選舉區內，並無解除職權問題。

此外，內政部認為，區域立委雖由其行政區域選出，但行使職權是以全國為範圍，代表全國國民行使立法權，是否立法限制區域立法委員當選後不得將戶籍遷出該選舉區，將廣泛徵詢各界意見，審慎研究，尋求共識。（王家俊／台北報導）
