與外表超齡國中女嘗禁果 獲不起訴

新竹市21歲林姓男子去年7月在網路結識外表比實際超齡的15歲國中少女，2度發生性行為，家人發現少女偷嘗禁果，怒控林男妨害性自主。

林坦承與少女發生性關係，但當時少女跟他說是高中生，沒有說到年紀，加上她看起來成熟，不清楚實際年紀。被害人作證指出，認識之初，男方有問她是不是學生，她回答「讀國三要畢業了」，沒說幾歲。

案件偵查時，當庭拍攝少女照片，檢方認少女看起來不像稚氣未脫模樣，很難從外表確認年齡，加上雙方已達成民事和解，被害人父母表示不願再追究，新竹地檢署今天以罪證不足，做不起訴處分。
