借貸不成　女上床後翻臉告性侵不成立

【法庭中心／台北報導】台北市吳姓男子被控去年8月利用女性友人酒醉性侵得逞，但北檢查出，女方清醒後曾以行動電話向吳男借款被拒才報案，與常情不符，認定2人性行為並非出於強迫，今將吳男不起訴。

吳男供稱當天凌晨是被害人主動邀約到KTV飲酒作樂，期間數度談及借款，離開KTV時被害人仍念念不忘借款，並與他一同返家發生性行為，沒有強迫。
 
檢方查出，女方清醒後第一時間，並未離開現場，或向他人求救，或即時報案，反而數度以行動電話聯絡吳男要求借貸，被拒絕後才向警方報案，且女子雖到醫院驗傷，但身體並無明顯外傷，顯與一般性侵情況不符，今將吳男不起訴。
