遭誤會搶男友　回應「讓妳笑不出來」遭告

【潘岳／宜蘭報導】宜蘭1名吳姓女子因與男友分手，懷疑是1名30歲沈姓女子橫刀奪愛，沈女得知後，傳了1封簡訊表示「清者自清、結論讓妳笑不出來」，解釋並未橫刀奪愛；吳女看到簡訊後，便多次要求沈女說清楚「結論」2字的意思，但沈女卻關機不予理會，吳女擔心沈女對其不利，並心生害怕，吳女便到警所控告沈女恐嚇；全案經宜蘭地檢署偵結，認為沈女簡訊內容非惡害之語，將沈女不起訴處分。
 
檢察官指出，恐嚇行為必須以不法之惡害通知他人，若以正當合法之事通知他人，雖讓他人心生畏懼，也不構成恐嚇罪。檢察官舉例，如要求加害人來宅道歉或和解，否則就提出告訴，或通知債務人遵照約定之期限清償債務，否則將依法追訴等，均不構成恐嚇罪之要件。
