台北市林姓男子因買便當猶豫不決，竟火大拿鋁製湯杓刺死責難他的廚師。最高法院日前駁回林男上訴，依殺人罪判他12年有期徒刑定讞。

判決指出，林男有搶奪等前科，並患有情緒控制障礙，平時打零工維生，並是長安西路一家便當店常客，但因為點菜時常折騰半天、猶豫不決，2013年7月去消費時遭到女店員埋怨，雙方爆發口角；店內廚師聽見林男大小聲，抄伸縮鐵棍衝出嗆聲「你要買就買，不買就離開！」林男見狀抓狂，順手拿起舀菜湯杓攻擊對方，打到湯杓都斷了，還拿尖銳斷杓猛刺頸部，讓廚師在送醫急救後仍不治身亡。

林男一審被依殺人罪判處15年徒刑，但他辯稱自己是為了自衛而反擊，上訴到台灣高等法院，但法官根據目擊者證詞認定他有殺人犯意考量，不過考量他有中度智能障礙的心智缺陷、辨識自己行為違法之能力較低，予以改判12年徒刑；最高法院日前駁回林男第二度上訴後，全案三審定讞。
