幾個月前 小弟自公司離職 前幾天收到前公司寄來存證信函，表示小弟離職前有將某些工作上的檔案寄出 違反雙方簽訂勞動契約規定 非經公司事前書面同意，不得複製機密資訊或 就機密資訊製作備份，且不得以任何方式洩漏、告知、交付或轉移予他人或 對外發表出版。如有違反應支付月薪資之10倍做為違約金。 也表示離職申請書上也重申前述規定(指小弟有簽名過) 但檔案並非客戶資料，僅平常工作上相關文件，實屬無心之過，也未將檔案洩漏、 轉移給其他人或從中得利。 存證信函上要求小弟支付違約金，否則公司將依法訴追法律責任。 小弟也立即與前公司人資窗口聯繫，但窗口徵詢長官後態度強硬，表示無協商空間， 就是要求小弟依照信函上金額給付。 想詢問大家，小弟該如何自救 謝謝 -- ※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 124.12.213.207 ※ 文章網址: http://www.ptt.cc/bbs/Salary/M.1403336567.A.604.html ※ 編輯: henrykuo (124.12.213.207), 06/21/2014 15:44:22
