針對苗栗大埔案行政訴訟拆遷戶勝訴，判決更指苗栗縣政府炒作土地，內政部長李鴻源表示，這4個拆遷戶剛好都在都市計畫案的角落，「要變更有變更的空間、要撤銷有撤銷的空間」，內政部會兼顧情理法處理此案，目前原則上是朝向「不上訴」規劃。

李鴻源說，內政部朝不上訴方向規劃，但整件事還是要等看到判決書，並與苗栗縣政府溝通後，才有明確的決定。

他說，土地徵收撤銷後，都市計畫也要跟著變更，這些都要與苗栗縣政府溝通，「要撤銷也是他們（苗栗縣）簽上來，都市計畫變更也是要跟苗栗縣政府溝通」。
