「一起看A片」生套話告師性騷　敗訴

【王吟芳／台北報導】屏東縣一名私立國中男學生指陳姓音樂男老師假藉他未帶直笛，將他單獨留在教室要求罰寫課文，「否則要一起看A片」，控訴陳師涉性騷擾並提告求償，屏東地院原判陳師賠償1 萬元慰撫金，但高雄高分院認定是該生在簡訊與電話中主動提「看A片」套話，今改判陳師免賠。

男學生指控，2011年5月陳師將他單獨留在教室，指他沒帶直笛要罰寫課文，「否則就要一起看A片」，使他倍感恐慌且影響受教權及人格發展，向陳師及學校連帶求償慰撫金30萬元並登報道歉。

老師供稱當天怕傷學生自尊才將他留在教室談話，但僅要求罰寫課文，根本沒有言語騷擾之事。
 
二審調閱學生提出雙方通話錄音與簡訊內容，發現並無陳師言語性騷擾事證，反而是學生一再對罰寫課文討價還價，並多次主動提及「什麼方案？答應和你一起看A片嗎？」認定為學生對老師套話，今逆轉改判老師免賠。仍可上訴。
