不當得利超過罰鍰最高額　擬向黑心業者追討

【邱俊吉／台北報導】衛生福利部擬向不肖食品業者追討不當所得，今邀法務部、財政部、食品、會計、財稅、法律等領域專家，討論追繳的方式，衛福部次長許銘能表示，依據今年新修訂的《食品衛生管理法》第44條的精神，該部認為當違規業者所得利益超過法定罰鍰最高額，且經中央主管機關認定情節重大者，應向業者追繳不當所得。

衛福部發言人王哲超說，希望這次會議能討論出重大違規業者不當所得的計算方式，以追繳扣除罰款後的金額，日後可作為地方衛生局執法依據。
