法務部說學運不蒐證不符常識

法務部長羅瑩雪今天中午視察台東地檢署，她表示，學運觸動公民不服從議題，有人主張因公民不服從，檢察官不應蒐證，甚至有法律系教授也這麼說，不符基本常識，所有偵查都要蒐證，包括大部約40%的不起訴案件，也都是偵查的結果，認定不構成犯罪，才會給予不起訴處分，不是偵查就把所有相關的人當成被告，一定要還原事實，才能依法處理，不要先阻止偵查，妨礙警方執行維護社會秩序的責任，以及檢察官偵辦刑案的工作。
