軍審法修法三讀 洪案適用

總統府13日公布軍事審判法修正案，15日將實施，未來在承平時期，軍法歸入一般司法。其中國防部法律事務司審判處副處長沈世偉表示，將會派憲兵戒護250名軍事犯，移送至法務部的11處監獄。當天憲兵和警察單位，將會以「任務車隊」進行「武裝押運」，沿途實施嚴密管制，以避免突發狀況發生。
軍審法生效後，軍方會將目前偵查中、審判中和執行中的案件，分成2階段移交給司法機關。目前軍事法院審理中的案件，共有178件，也將於15日起全面移交給全國24個普通法院。另外包括林毅夫、林賢順等叛逃軍官，則會在第二階段移交出去。
國軍台南監獄，目前約有300名軍事犯，預計15日當天，會有250人進行移監，包括台北監獄、彰化以南等11所監獄；另外將15位軍院、1位軍檢的在押被告移至看守所。
這250名即將移監的軍事犯當中，最大咖的屬3名中將程士瑜、陳友武和何雍堅；法務部表示，將軍級的軍囚被移到一般監獄，「該上工的就上工」，全都一視同仁；另外除了這3名中將外，還有少將張晉德和羅賢哲，以及海軍前上校郭力恆。
