【突發中心／台北報導】京劇名校爆發學長逼學弟教室尻槍性霸凌事件！今年1月、上學期最後1堂課時，術科名師讓學生自行回到教室複習學科，不料竟發生兩名學長竟在教室逼學弟，「把褲子脫下來打手槍給我看」，學弟乖乖就範，事後身心受創，只敢偷偷向同學訴苦。
 
家長不滿名師不上課害兒子受害，卻能獲選學校優良教師。名師受訪坦承事發時正在別間教室排戲，為此感到內咎與自責。

【政治中心／台北報導】立法院今召開談話會，討論臨時會議程，但反黑箱服貿民主陣線，採取「拂曉進擊」策略，趁警力還沒完全部署完成之前，一大早五點多就衝盡立院議場前，並引爆多波肢體衝突，後遭警方排除到院外。

立法院預定上午11時舉行立法院全院委員談話會，決定臨時會討論議程，30日到8月9日審查議案。

日前（7/26），司法院刑事補償庭駁回蘇建和等三人,因不服台灣高等法院認為蘇等三人須為該案調查起初自白負過失責任而裁定補償三人共一千五百餘萬所提之覆審並定讞，亦即每人獲得五百萬元左右的補償。司法院刑事補償庭認為，無明確證據指稱蘇案被告三人自白出於刑訊，因此對三人自白犯罪自負過失責任。筆者以為，司法院此舉，無疑混淆自白與認罪之區別，甚至有認為被告自白使國家機關即得以取得刑罰正當條件之嫌。
 
現行刑事訴訟法中有關於自白與認罪的規定。自白於刑事訴訟法係屬證據章節，亦即為犯罪事實之認定而發；指涉於刑事實體法而言，應屬於被告於「構成要件」該當與否之認定問題。
 
《刑訴法》第156條規定自白之證據能力，並規定自白不得作為唯一之證據。認罪則屬於刑訴法第455條之2以下的協商程序，著眼於我國刑事訴訟法以朝改良是當事人進行主義方向修正，位建立良好的審判環境，本於「明案速判、疑案慎斷」之原則，運用於被告不爭執的非重罪案件，使其快速終結，俾使法官有足夠時間及精力致力於重大繁雜案件之審理。
 
認罪協商本於被告對於其所受指控犯罪事實不予爭執，並願意承受刑罰而發，審判機關為求訴訟經濟，對被告予以有罪判決。換言之，認罪對應於刑事實體法而言，乃屬「罪責」層次。即被告於犯罪事實構成要件該當之行為並無爭執、推定具有違法性，而予以刑罰評價之罪責議題。由此來看，縱使蘇案被告三人曾經自白，亦僅屬於犯罪事實認定之問題，而不及於責任之承擔，更應無因此承擔過失之責任。遑論該自白係出非法取得！
 
自白與認罪之間界線不明，其來有自。自歐洲中世紀以降，悔罪、自白、贖罪三者夠成了告解，是為基督教會（舊教）聖事之一；教徒必須向教會告解以求與上帝之連結，避免在末日審判之時無法回到上帝身邊。自白不只是說出自己所犯的過錯，更表達自己願意承受刑罰以為贖罪可能，以現代法學觀點而言，即包含了構成要件與罪責二個層次。刑罰因此也取得正當性。這項技術並未因為世俗國家興起而結束，卻逸散於世俗社會，甚至進入司法場域，成為國家刑事司法取得刑罰正當性的程序。有趣的是，在傳統中國儒學中，我們也可以找尋到類似的模式。儒學強調「克己復禮、改過遷善」，向自己或向他人陳述自己的過錯、接受懲罰，以為再教化的可能。這在宋明時期更為明顯。以儒學為基礎的傳統中國法，亦可見其蹤跡。被告對於自己犯罪行為的陳述與承認，即為口供與招認。晚清民初，我國繼受近代西方刑事訴訟法律體系，雖引進西方刑訴法理，限縮自白於證據之評價，但當時仍有被告自白即不得不予以有罪判決之語。
 
然而，在現行刑訴法理中，自白係屬證據之一，認定被告之犯罪行為，既已確定，刑訴法甚至引進美國法之認罪協商程序，更可知自白與認罪之不同。筆者認為，司法應釐清自白與認罪之區別，以法史發展為借鑑，切勿以自白為認罪之前提，以此為刑罰之正當條件，甚至要求被告自負責任！

中華統一促進黨總裁張安樂今天拜訪政務委員楊秋興，兩人交換對兩岸關係的看法；楊秋興表示，兩人交談愉快，張安樂和他一樣都贊同總統馬英九提出的「不統、不獨、不武」方向。

楊秋興說，張安樂透過民進黨涂姓友人和他連絡，說要和他聊聊，他認為大家聊聊並沒有什麼不好，就約好到他博愛路的個人辦公室見面，在場還有許多朋友，大家一起喝茶、閒聊約五十分鐘。

楊秋興指出，大家都沒有談到任何選舉話題，較多時間談到對兩岸關係的看法，他告訴張安樂自己支持馬總統兩岸維持現狀的看法，維持現狀對兩岸、對台灣和對中華民族都較有利，張安樂的想法也和他接近。

楊秋興說，和張安樂見面，並沒有考慮太多政黨的問題。

【綜合報導】義大利南部艾凡里諾省（Avellino）當地時間周日，發生連環車禍，根據CNN引述義大利新聞社（ANSA）報導，目前至少已造成24死、11人重傷。這場發生在艾凡里諾省的慘劇，主要是一輛巴士衝撞近10輛車後，從將近30公尺高的高架橋上摔下，車上據稱約有40名乘客，目前尚無法得知事故發生原因。早先ANSA曾稱已有30死，但稍後修正為24死。
