【綜合報導】日本氣象廳昨日表示，經過日本東南方的黑潮將出現睽違8年的「大蛇行」，呼籲漁家和沿海居民注意。

據了解，2005年才出現過黑潮大蛇行的狀況，而今年將有可能再度出現，蛇行時間約為1~2個月。而黑潮蛇行帶來最大的影響，就是漁獲量改變，2005年因黑潮蛇行，而讓當時漁獲量減少。而黑潮蛇行也會改變漲潮狀況，沿海很有可能出現淹水現象，氣象廳呼籲民眾注意。

洪慈綪說，她能體諒外交部和法務部處理此案時遇到的困難，雖然時程有點遲緩，但最後的結果家屬尚能接受，「我們還是要給他們讚美一下。」至於漁權重啟談判的問題，她希望漁業署再加把勁，保護漁民的生計安全。

洪慈綪表示，先前傳出菲方調查報告會強調「過失非蓄意」，家屬無法接受，若菲依殺人罪起訴開槍者，「那家屬可以接受」。

洪慈綪說，道歉的事，菲國的委任律師跟台灣的委任律師一直有在談，而且獲得菲國授權的聲明書她也已經看過，確認有「道歉」兩字，至於其他的詳細內容，在今天雙方會面後對外公開。

賠償問題方面，洪慈綪表示，雙方律師確實曾經談過，但家屬堅持「先道歉再談賠償」的立場，加上台菲國民所得有差距，賠償金額多寡還得進一步研商。

發生於5月間造成台菲關係緊張對立的「廣大興28號」漁船，台菲下午同步完成偵結動作。法務部官員表示，台、菲偵辦廣大興事件，結果雙方大致相符，包括菲海巡隊員槍擊我漁船的事實經過，以及殺人的起訴罪名。不過，雙方對於犯罪地點仍存有認知差距，屏東地檢署依據廣大興的航跡圖，認為菲方公務船槍擊的地點，發生在我國的領海不容質疑，但菲方認為是發生在菲國的經濟海域。

法界人士表示，屏東地檢署的偵查起訴菲涉案海巡隊員的動作，因台菲雙邊並無外交關係，也不發生引渡兇嫌的問題，但事涉我司法管轄權，我方必須以偵結動作表態，並發佈通緝；至於在菲國受審的涉案海巡隊員，未來有罪執行完畢後，除非進入我國領土，我方才能加以逮捕。

據了解，菲國司法部門是依據該國刑法所謂的一般殺人罪(Homicide)起訴，但不同於加重殺人罪 (Murder)；法界人士說，菲國因為廢除死刑，因在菲方刑法各罪章中，刑度最重的 (Murder)，是從20年又1日有期徒刑到最重的40年有期徒刑，至於一般殺人罪的 (Homicide)，刑度則為12年以上20 年以下有期徒刑。

據指出，涉犯槍殺廣大興28號船員洪石成的菲海巡隊員，在菲國隸屬於交通部門，不同於我方的海巡署，菲方偵辦期間，被偵辦的菲海巡隊員家屬一再向菲國總統陳情，加上菲國國家調查局的調查結果，認為涉案隊員並未涉及利用優勢武力殺人罪，最後經菲國總統批核，將本案定調為一般殺人罪。

法務部官員表示，我國的刑法殺人罪，最輕法定本刑為10年以上有期徒刑，到最重的死亡或無期徒刑，菲方以刑度從12 年起跳的一般殺人罪追訴，與我國司法審判實務中對殺人罪的判處刑度接近; 官員表示，近10年的統計顯示，我國被控殺人罪的刑度，被判死刑或無期徒刑的比率大約為百分之15 左右，大部分的刑度在20年有期徒刑。
