王金平保住立法院長後，即將開議的國會新會期運作是否更順暢？或是朝野對峙還將升高，導致議事延宕空轉？關鍵不僅在王金平，也在公開質疑王金平的馬英九總統與行政院長江宜樺。

在野黨先前對王金平策略性支持，無非是著眼於未來的議事運作順暢，如今，王金平穩住國會龍頭，在野黨勢必要討人情。然而，總統府高層昨天取消下周一的立法行政研討會，無疑的將為下周開議的立法院新會期投下新變數。

弔詭的是，在野黨一方面支持王續留國會，另一面要求國會議長退出政黨運作、保持議事中立，卻與王金平昨天一番「尊馬」、「忠黨」言論，有所矛盾。王金平如何回應在野黨支持及人民對他的肯定？國會議長該如何作為？王金平要有明白的宣示，這也對未來立院能否順暢，具有穩定性及關鍵性的影響。

民進黨立法院黨團總召柯建銘上午以「勝負不在疆場，強敵不在陣前」，呼籲馬認錯、道歉，展開朝野對話及大和解。柯建銘認為，國民黨身為國會最大黨，卻不願尊重國會，對包括ECFA、兩岸服務貿易協議等重大議案，都跳過國會執意推動，更吝於和在野黨對話，導致事事受阻，卻反怪罪國會，更打算拔掉自己黨的國會議長。

以往王金平得以調和各方，不僅因他是國會議長，也因為國民黨為國會最大黨，再外加王金平與在野黨談得上話的好交情；然而柯建銘這番話，看似從民進黨立場出發，卻也像是為王金平過去五年難以揮灑的處境發聲；在王金平暫時保住立院龍頭寶座後，馬英九若無法和王各退一步，找到合作的共同的利益，馬王勢將展開新一波的政治能力表現競賽，而與國民黨有選舉矛盾的在野黨，對馬政府議事也只有重回杯葛一途。

尤有甚至，若馬對王繼續進逼，加深國民黨內部矛盾，非但黨紀無法貫徹，部分黨員更可能在重大議題上，選擇與在野黨聯手，擋下馬政府任何想過的重大議案，馬的八年執政恐怕難以收場。

在台北地方法院昨天裁定暫保立法院長王金平的國民黨員資格後，馬英九總統今天首度對此事表達看法。他表示，相關訴訟會繼續進行，但國家大事該做的還是要做，政務也還是要推動；他也重申，立法院長涉及司法關說「是大是大非的問題」，特偵組向他報告此事，他既不能掩飾、也不能不處理，「否則豈不就是『吃案』」？

黃世銘辦關說 「事前並不知情」

馬總統今天在非公開場合與媒體談及相關看法，對外界以「政爭」形容關說案爆發以來的政局，馬總統也強調，檢察總長黃世銘辦此案，他事前並不知情，「此事沒有陰謀、也沒有政治鬥爭」。

總統府發言人李佳霏上午也表示，馬英九總統無法接受立法院長關說司法個案，這個立場絕對不會改變。但地方法院做出了裁定，總統表示尊重。

被說政爭 堅持「不能吃案」

李佳霏指出，馬總統堅持捍衛司法獨立與司法紀律的立場從未改變，為了台灣的民主法治發展，無法接受立法院長為了在野黨黨鞭的司法案件，關說法務部長及臺高檢檢察長，這是全民都應該堅守的紅線。「在抗拒政治力量關說司法案件這件事情上，沒有任何灰色地帶，也不容猶豫妥協」。

據了解，對於理應是涉及司法關說的大是大非問題，一路以來都被以藍營內鬥解讀，甚至有流於民粹的趨勢，馬總統私下難免感到遺憾，但依然堅持「不能吃案」的原則。且儘管民調因此再下挫，總統仍期待社會理解他對司法關說案無法坐視不理，對有理念相同者聲援送暖，他也非常感謝。

立法院長王金平暫時保住國民黨員身分，但有律師資格的同黨台中市議員洪嘉鴻今呼籲，王金平應展現智慧，主動請辭優雅下台，他願辭去議員資格相陪。

洪嘉鴻今召開記者會，高舉「平安是福」、「優雅下台」看板，呼籲王院長顧全大局。

他強調，王金平涉入民進黨立院黨鞭柯建銘關說案，遭國民黨撤銷黨籍，現透過司法途徑，保住黨員身分；民進黨傾全黨之力，護衛王金平的不分區立委身分，王金平唯有優雅下台，才能還其忠黨清白。

陳姓男子僅因細故就持鐵鎚拔釘器重擊胞弟10多下致受傷。最高法院認為陳男手段凶殘，依殺人未遂罪判處8年徒刑定讞。

根據判決書指出，台南市59歲陳姓男子被控因遺產糾紛與胞弟有嫌隙，於民國100年8月間，趁胞弟開車至工地準備卸水泥時，持鐵鎚拔釘器重擊其頭部10多下。

所幸現場其他人察覺，將陳男胞弟送醫急救，才倖免於死。

最高法院維持台灣高等法院台南分院認定，陳男的揮擊力道及速度，配合鐵鎚拔釘器的外觀及重量分布，所產生的殺傷力遠較其他一般市售器械為強，陳男有殺人故意，依殺人未遂罪判處8年徒刑定讞。
