【陳威廷／台北報導】102年度全國SUPER教師得獎者下午揭曉，幼稚園組是高雄市前金幼兒園的陳秀萍、國小組是台北市興雅國小錢劍秋、國中組是彰化縣員林國中曾明騰、高中職組是台中市后綜高中的戴金鼎、大專組則是中國醫藥大學謝文聰，各可得獎金5萬元。

后綜高中籃球隊在戴金鼎帶領下，打破23年來台中市沒有公立高中職打進高中籃球聯賽全國賽的紀錄，讓瀕臨解散的球隊重獲支持，今年可望再度擠進全國決賽。戴金鼎說，后綜高中曾是後段高中，學生逛街都不敢讓人看到書包上的標誌，籃球隊的成績也不盡人意，幾度面臨解散，他帶隊後，決定用籃球成績讓后綜的學生重拾信心。他指出，自己曾經被退學過，當過混混，很了解成績後段學生的想法，他將心比心，孩子被他感動願意辛苦練球，去年擠入全國賽，讓全體后綜師生皆感榮耀。

【綜合報導】這樣的景象，真的讓人感到不可思議，野生動物攝影師蒙地史隆，在印第安那州的野狼生態公園中拍攝時，狼群居然朝他撒嬌，又親又磨蹭，賴在他身上，絲毫沒有攻擊他的意圖。
 
雖然根據公園描述指出，狼群不會朝獵物咆嘯，而是會顯得相當興奮開心，甚至看起來很友善的樣子，不過史隆表示當時狼群絕對沒有把他當獵物，就像小狗一樣，依偎在他身邊和他玩耍，這樣的行為完全和大家以為的背道而馳，不過事實上野生的狼並不危險，牠們反倒對人類相當懼怕，看到人類就會立刻逃跑確保安全。

File Server：Windows 2008R2 64bit AD ：Windows 2008R2 64bit DFS：Windows 2008R2 64bit 使用者環境：Windows XP 所有使用者都有加入Domain 假設 A帳號為Domain Admin B帳號為RD部門主管 C~F為RD部門人員 資料夾的結構為(有三個資料夾) FilesShare/RD/Project1 FilesShare/RD/Tool FilesShare/RD/Cost 我將File Server的FilesShare資料夾開共用，DomainAdmin 有讀取/寫入權限，Domain User只有讀取權限 重點來了 我要如何設定才能指派 B(部門主管) 擁有設定資料夾的權限 我要設定成，讓B能夠去指派像是以下的權限 Project1資料夾可以由B指派只能給C.D存取和修改 Tools資料夾可以讓B~F皆可以讀取，但只有B能夠修改 Cost資料夾可以讓B設定只給E.F修改，其餘C.D.E只能讀取 我有試過直接開給B完全控制，一樣不行(在資料夾安全性的頁面，新增和刪除都反白) 但是，一樣的設定，卻可以在Windows 7卻可以新增和刪除部門內的使用者 不曉得是我有那裡設定錯誤嗎?? 請各位前輩指教 -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 1.173.146.61

馬王政爭中，被特偵組公開表事涉入關說案的王金平、曾勇夫、柯建銘、陳守煌、林秀濤等人，依法界人士判斷，無一人需負刑責。除了王金平向向曾勇夫、陳守煌「關說」事證薄弱，無法追訴；林秀濤也沒有明知錯判而故意不上訴，不算有罪。對於「關說」與「關心」之間的爭議只在一線之隔，律師尤英夫認為，只要未涉及金錢交易法律上便無罪；律師林敏澤也說，關說是官場、法界上「必要之惡」，往往能讓檢察官更謹慎處理案件，挽救當事人的權益。

世紀聯合法律事務所律師尤英夫受訪時說，涉入關說案的王金平、柯建銘等人應該是無罪的，關鍵在於關說是否成立，和後來有沒有上訴。而針對林秀濤是否有因高檢署檢察官陳守煌指示而不上訴，尤英夫說，陳守煌已表示「沒有叫林秀濤不要上訴」，在法律上就無法追究。

律師林敏澤受訪時也說，以此案而言，被指關說的王金平在錄音中並無明確指示被關說者一定得如何處理案件，僅以「有罪就上訴，無罪就不要上訴」的方式來提醒；陳守煌經驗老到，且法律常識充足，應不至於強迫檢察官是否一定要上訴。他說，檢察官只要不是明知錯判而故意不上訴，便不算有罪，雖王金平和陳守煌可能會受到道德上的非議，但並沒有刑事責任，也無教唆之嫌。

據媒體報導，柯建銘「全民電通背信案」，法院已作出無罪判決，但特偵組與檢察官黃世銘認為，背信罪是即成犯，應該上訴，因此認定檢察官林秀濤有受關說影響。但林秀濤認為，被告是柯建銘涉及的1200萬債務，最後還是要由柯建銘承擔，且她認為背信罪屬結果犯，上訴並沒有實益。

根據《刑事訴訟法》，檢察官有權依個人心證與法律，獨立決定是否依法提起上訴，並無不法。林秀濤認同高等法院判決結果，因此決定不上訴。

另外，尤英夫說，王金平到底是「關說」還是「關心」也很有爭議。依他聽起來比較像「客套」或「敷衍應付」，若涉案人之中沒有金錢往來，光要以監聽譯文定罪有點太過牽強。針對5名涉案人是否有行政責任，尤英夫則說，監察院只負責行政體系，不能涉入立法或司法，因此只有陳守煌和曾勇夫勉強能算是有行政責任，但似乎兩人都沒有明顯罪證，在此次風波中成了冤大頭。

林敏澤也提到，關說本身是無罪的，且關說在官場、法界上已是「必要之惡」，雖然可能會引起道德非難，但有時檢察官經提醒或打聲招呼，也許會更加謹慎、仔細的處理案件，因而避免濫訴或判斷錯誤的現象，間接挽救當事人的權益。

另一位資深法界人士受訪時則表示，若真要定罪，僅有林秀濤、曾勇夫、陳守煌勉強可能會因刑法第125條的「明知為有罪之人，而無故不使其受追訴或處罰者」，可能有刑事責任，但因為沒有證據證明他們是針對特定的人或事，要求檢察官不起訴，因此依無罪推定原則，林秀濤、曾勇夫、陳守煌等人可能還是無罪。
