【賴又嘉／台北報導】明台產險公司陳姓前總經理、汽車保險部葉姓前協理及明台詹姓前顧問，遭控於2002年到2007年間，指示投保車險的員工充當人頭，向總公司申請「第三責任險」理賠金，再將理賠所得款項挪作各銷售區的統籌款，作為支付招攬客戶的超額佣金，還另向明台投保的中央再保險公司申請再保攤賠，據此詐領理賠金。
 
明台產險內部經清查後提告，北檢查出，陳男等人多年來共向中央再保險公司詐領2089萬餘元，今依詐欺、偽造文書等罪，將陳男等人起訴。

【孫友廉／新北報導】劉姓女子（35歲）今年3月1日下午3時許，騎機車路過新北市鶯歌區鶯桃路，往鶯歌方向，卻在永和街的丁字路口，與二段式左轉、要往永和街方向，年約40餘歲王姓女機車騎士發生擦撞，劉、王兩女均當場倒地受傷。
 
王女對劉女提出過失傷害罪告訴，說劉女闖紅燈，而劉女則覺得麻煩未提告。新北地檢察署檢察官調閱現場監視錄影，比對交通號誌時相、紅綠燈秒數後，發現肇事當時，被告的劉女行車方向應是黃燈要準備轉換為紅燈，提告的王女則還在紅燈，應是王女闖紅燈，因此將劉女不起訴。

【李銘宏／新北報導】今天凌晨2時許，新北市消防局接獲報案，表示三重區仁義街一間製作油條的工廠有火光，抵達現場後發現是工廠內的風管起火燃燒，目前以順利將火勢撲滅，並未傳出有人受傷受困，詳細起火原因仍待調查。

有爬過文說轉賣正版的函授資料是不違法的 但是，在補習班給的小冊子上又看到 著作權法第91-1條 第 91-1 條 擅自以移轉所有權之方法散布著作原件或其重製物而侵害他人之著作財產權者， ^^^^^^^^^^^^^^^^^^^^^^^^^^^^ 處三年以下有期徒刑、拘役，或科或併科新臺幣五十萬元以下罰金 而想請問，到底轉賣正版的函授資料是否有違著作權法? 謝謝 -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 203.67.5.206

閣揆江宜樺 如趙高再世 指鹿為馬 顛倒是非 立刻公開道歉 否則百倍奉還 自主計總處上月公布實質薪資更衰退到16年前水準，幾乎同時行政院長江宜樺對公開宣稱，2001年法定工時由每週48小時縮減為雙週84小時；縮減工時相當調升12.5%的薪資，2005年實施勞退新制，企業每月需提撥月薪6%勞工退休金，比原來最低提撥率2%增加了4個百分點，這部份相當於調薪4%。而昨日更有甚者如主計處長石素梅於立院報告時，急於拍馬屁護主呼應之，聯盟對閣揆江宜樺的謬論表達嚴正抗議如下： 說好的牛肉在哪裡？ 全面週休二日連個鬼影都沒有！ 回顧歷史，國際勞工組織ILO早在1935年頒布第47號公約（Forty-Hours Week Convention），要求會員國將工時降到每週40小時，迄今已78年台灣仍未跟上腳步，卻看到江院長視民進黨主政時期的雙週84工時修正，視為惠賜勞工的「加薪」之舉，實在精神錯亂令人哭笑不得。而執政邁入第六年頭，馬總統所謂「全面週休二日，一週八小時工時」政策，更是連個鬼影都沒有！ 勞退新制為勞工加薪？ 江院長趙高二世？ 指鹿為馬顛倒是非？！ 至於勞退新制的修法，連現任勞委會主委潘世偉於2005年的撰文「勞工退休金機制與政府責任」都提到：「勞退新制乃解決舊制退休金的弊病，也就是要解決勞工要在同一企業從一而終才可以領到退休金」。以免勞工待年屆退休時面臨雇主惡性解僱、關廠，革除舊制退休金「看得到但拿不到」的弊病，並非加薪，僅是讓勞工的老年經濟生活得到起碼保障。 這樣的制度弊病，加上過去政府長期放任雇主對勞退舊制提撥不足甚至完全不提撥，才有這兩年逼高齡阿公阿嬤臥軌的全國關廠工人連線抗爭運動。江宜樺院長不關心工人臥軌抗爭的前後因果，放任勞委會苦苦逼殺，更不瞭解勞退新制修法的本質根本是讓絕大多數的雇主了結對舊制的提撥義務，還將其視為「加薪」，聯盟試問這種指鹿為馬顛倒是非的行徑與中國秦末佞臣趙高，有何不同？ 聯盟訴求：江宜樺公開道歉 否則號召勞工「百倍奉還」！ 聯盟要求行政院長江宜樺，於三天內立即協同相關內閣成員向全國勞工正式公開道歉，否則聯盟將進一步發起「激進」的抗爭行動，待一「天賜良機」必定「百倍奉還」！！！ 新聞聯絡人：台灣青年勞動九五聯盟執行委員 胡孟瑀（0921132607） http://service-95.com/?p=473 -- 哈里路亞！我仍活著。 工作，散步，向壞人致敬，微笑和不朽， 為生存而生存，為看雲而看雲， 厚著臉皮佔地球的一部份...... ※ 編輯: moskito 來自: 118.168.1.211 (10/10 01:14)

馬王政爭已滿一個月，行政院長江宜樺不願道歉，白跑立院六趟。杯葛議事雖是民主常態，但不能藉由質詢行使監督政府的權力，也是立法院的失職。面對國會僵局，民眾不禁要問：「道歉、開會，有那麼困難嗎？」

對於政局動盪，工商業界也看不下去，六大工商團體負責人今天將拜會立法院長王金平。但據了解，王金平上周「江王會」後，私下已表示「我都不在乎了」，甚至連民進黨團「憲政危機處理七人小組」也認為江宜樺「表示一下」就可以；只是以柯建銘為首的民進黨立委仍強烈要求江揆「沒有道歉、沒有上台」，而江揆也不肯輕言道歉。

如果馬王之爭的當事人王金平都不願追究江宜樺的「失言」責任了，在野黨應沒有堅持的道理，但特偵組監聽國會總機事件，讓朝野立委群情憤慨，形成更難解的僵局。

江宜樺雖堅持「不對沒有說過的話道歉」，但時移勢轉，在特偵組被爆監聽立法院總機之後，檢察總長黃世銘已先表示歉意，又在立委質詢下承認確有疏失；就算調查結果「只是疏失」，身為全國最高行政首長，難道不需為此造成院際關係緊張而「道歉」嗎？

其實，馬王之爭演變至今，鬥法已成鬥氣。在法律上，王金平遭國民黨撤銷黨籍，已提起民事訴訟及假處分；王、柯被爆司法關說部分，立法院紀律委員會最快本周五也會討論如何處理。但法律程序並非一時半刻可以終結，國家卻不能因政治上的不願妥協而阻滯前進。

江宜樺願意與王金平會面化解誤會，如果為了政局和諧，公開道歉有何為難？而口口聲聲要監督政府的在野黨，寧可讓行政院長及部會首長到立法院枯坐當「低頭族」，卻不願行使憲法規定的立委質詢權，如此稱得上對國家忠誠的反對黨嗎？

標題[心得] 建議一定要注意強制險過期問題

各位車板大大好 由於親戚遇到一起車禍，所以提醒一下強制險真的很重要 千萬不要過期了沒注意，趕緊續保 事情是這樣的，我親戚家前方發生了一起車禍 一名 TOYOTA 駕駛高速逆向撞擊共七台路邊未違規停車的車輛， 包括全毀的機車，半毀的汽車， 但是對方強制險過期沒有續保... 所以現在刻意拖延不處理 親戚的部份聯繫受害者，有的是打算找民代來協調 也有聽說有人打算找【人】來橋， 不過話說回來，如果強制險沒有問題，應該不需要搞的這麼複雜 想當然爾，肇事駕駛連強制險都沒保了，更別提其他如車體險類的 他自己的一年車 白色 Toyota Camry 車頭全毀，BC柱和車軸嚴重變形 應該修好也沒用了... 頂多是作零件車，不然就是銷給黑心車行吧 總而言之，請各位注意強制險是否過期，罰錢事小 一不小心發生車禍，可能賠起來小朋友會大舉叛逃..................... -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 111.251.121.35
