昨挾持高雄大寮監獄的受刑人鄭立德，透過矯正署發表5點訴求，訴求之一是因不滿前總統陳水扁可保外就醫，監獄裡比陳水扁病情還嚴重的卻不能出來。對此法務部政務次長陳明堂上午10時召開記者會表示，了解受刑人的訴求，但去年12月法務部組成醫療小組時，已對外公布5點大家一起適用的條件，當時也請各監獄拿給所有受刑人了解，「他們對這方面是不是有所誤解或偏見？」
 
法務部當時根據矯正署保外醫治審核參考基準，表示受刑人只要有下列各款情形之一者，監獄得報請矯正署准其保外醫治，包括「一、罹患致死率高疾病，預料短期內將因而死亡。二、身心障礙嚴重，無法自理生活，在監難獲適當照護。三、病情嚴重必須長期監外住院治療。四、肢體障礙嚴重，必須長期在監外復健。五、病情複雜，難以控制，隨時有致死之危險。六、罹患法定傳染病，在監難以適當隔離治療。」法務部當時也指，受刑人一體適用。（法庭中心／台北報導）
