幫朋友代問，已查閱精華區跟搜尋「足月」兩字 朋友是月薪制，月薪25K。並無訂定書面契約。 他從7/7開始上班，週休二日，每日上班9.5HR 結果七月份薪水不到15K(已扣除勞健保) 他的老闆告知她，因為不足月，所以用時薪計算。 想請問： 1、可否不足月卻用時薪計算呢？ 前文有大大推文說，有書面依書面、沒書面依約定， 那若兩者都沒有，似乎可以用時薪計算。 請問有法規依據嗎？ 2、正確計算方法是？ 依照前文的推文，可以拿到的薪資應該是25000-6*(25000/30)=應得薪水 ↑7/1~6未上班部分扣掉 可否提供相關的法規依據阿？ 先謝謝大大好心回答了，感激不盡。 再次感謝，祝福都有良好的工作環境跟老闆阿。 -- ※ 發信站: 批踢踢實業坊(ptt.cc), 來自: 140.123.218.167 ※ 文章網址: http://www.ptt.cc/bbs/Salary/M.1409478650.A.5C2.html
